Related MaterialsAlready signed by Clinton, if ratified by the Senate, places control of firearms and ammunition under Executive control. No Congressional approval required! Initially would outlaw handloading.

HR 45 Test required for eligibility. Applicant must provide all mental health records. Permanent registration required for all firearms. $25 fee per gun. All transfers, even within family, must go through an FFL dealer. Severe storage requirements if minors live in the house.

Assault Weapon Ban
This has been been announced, but not actually entered. Basically the old Clinton ban with a much longer list of banned fire arms. Link to text will be added when available.A letter to Holder opposing reintroduction of this bill was signed by 65 Democrats in the House. See text. A hopeful sign that it may not be introduced this session.

any "semiautomatic rifle or shotgun originally designed for
military or law enforcement use, or a firearm based on the
design of such a firearm, that is not particularly suitable for

Gun Shows
S. 843 places severe restrictions on gunshows including a mandatory signed log of an attendees, with addresses verified with photo ID. It also requires permanent records of all gun transactions (de facto registration).

National Park Gun Ban At the end of the Bush term a change was implemented to make gun rules in the NPS land conform to the laws of the surrounding state. One federal judge issued an injunction against the implementation of the new rules and the Obama administration declined to appeal the ruling. The senate voted 67 to 29 and the house 279 to 147 for the Coburn amendment. This really only applies directly to CC licenses, but is a step in the right direction.

Montana
Gov. Brian Schweitzer has signed into law a bill that aims to exempt Montana-made guns from federal regulation.
This is going to be a tough fight. Not only is it an in-your-face stance, there are already several Supreme Court decisions allowing the federal government to control materials commonly used in interstate commerce even though neither is the local producer involved in interstate commerce nor does the actual product ever leave the state.

Bills similar to Montana's have been offered in:Sovereignty Resolutions 37 states have introduced 10th Amendment resolutions in some form or other.

I cannot hope to keep up with all state level gun related bills. However, there are two I am researching for inclusion. One is the ammo serialization and registration because it has been introduced in several states. The other is California's "Safe Gun Roster". Washington, DC is trying to use a similar method to circumvent the Heller decision. If successful, we can expect a number of these. Cap'n Ball |
Microstamping Ammunition See:
In 2008 Congress and these states; Arizona, Connecticut, Hawaii, Illinois, Indiana, Maryland, Mississippi, Missouri, New York, Pennsylvania, Rhode Island, Tennessee and Washington. had microstamping bills. Watch out for re-introduction as in New York. California passed one.

California California maintains a "Safe Gun Roster". Sale of any gun not on the list is illegal. The manufacturer must pay a $200 annual fee for every model. If the gun was made after 2007 and the manufacturer does not continue to pay (as in the case of a discontinued model) Further sales become illegal. If a gun comes in a choice of colors or finishes, each is considered a separate model. Lots of other stuff too, like a chambered round indicator on semi-autos. The best description I have found of a rather convoluted series of laws is in the SAF Complaint.
